नई पार्टी कैसे बनाते हैं? सारे नियम-कानून जान लीजिए।
राजनीतिक पार्टी कोई भी व्यक्ति या संगठन बना सकता है. उसे राष्ट्रीय या राज्य की पार्टी भी कह सकता है. लेकिन ऐसा कहने भर से उसे मान्यता नहीं मिल जाती. इसके लिए जरूरी है चुनाव आयोग की मुहर |
दरअसल, रिप्रज़ेन्टेशन ऑफ दी पीपल्स एक्ट, 1951 के सेक्शन 29A के तहत कोई भी अपनी राजनीतिक पार्टी बना सकता है. पार्टी का ऐलान करने के तीस दिन के भीतर रिप्रज़ेन्टेशन ऑफ दी पीपल्स एक्ट और संविधान के अनुच्छेद 324 के तहत पार्टी को चुनाव आयोग में अपना आवेदन देना होता है. इसके अलावा ऐलान से साथ ही दो लोकल और 4 राष्ट्रीय स्तर के अखबारों में नई पार्टी की जानकारी छपनी चाहिए. इसके बाद 30 दिन का समय दिया जाता है आपत्ति दर्ज करने के लिए. नई पार्टी के नाम के खिलाफ कोई भी आपत्ति दर्ज करा सकता है. अगर आपत्ति दर्ज की जाती है तो इसकी सुनवाई चुनाव आयोग के सामने होती है. अगर कोई आपत्ति नहीं आती है तो आपको हरी झंडी मिल जाती है.
क्या प्रकिया है?
चुनाव आयोग में रजिस्ट्रेशन के लिए ज़रूरत होती है एक एप्लिकेशन फॉर्म यानी आवेदन पत्र की.
लेकिन इस आवेदन के साथ आपको कुछ जरूरी दस्तावेजों और फ़ीस भरने की भी दरकार होती है. मसलन, आवेदन के साथ 10 हजार रुपये का एक डिमांड ड्राफ्ट देना होता है.
आवेदन के दौरान पार्टी में कम से कम 100 रजिस्टर्ड मेंबर होना जरूरी है. इसके अलावा आवेदन पत्र के साथ एक हलफ़नामा जमा करना होता है कि जिसमें पार्टी अध्यक्ष और जनरल सेक्रेटरी यानी महासचिव को दस्तखत करने होते हैं और नोटरी/ओथ कमिश्नर/फर्स्ट क्लास मजिस्ट्रेट के सामने ये शपथ लेनी होती है कि पार्टी का कोई भी सदस्य किसी दूसरी पार्टी का सदस्य नहीं है
